En este trabajo intento mostrar, contra la tesis de D. James, que existe una relación de continuidad entre la teoría del derecho internacional del Fundamento del derecho natural y de El Estado comercial cerrado de Johann G. Fichte, basándome en dos razones. En primer lugar, en ambos textos la propiedad de los ciudadanos puede ser garantizada sólo si el Estado es soberano en relación con los demás para planificar su propia política económica. En segundo lugar, si bien en El Estado (...) comercial cerrado se restringen las relaciones comerciales entre los ciudadanos, también quedan abiertos otros tipos de relación entre los ciudadanos de diferentes Estados. ABSTRACTIn this paper, I intend to reconstruct the main points of Taylor’s politics of recognition, starting from the debate about negative and positive liberties. Then, I will focus on the role of the ideal of authenticity in this conception of freedom, as well as on the dialogical conception of the self. Furthermore, I will develop the political consequences of these ideas. In addition to examining McBride's argument about the oppressive character of recognition, I will also address Fraser's objection concerning the (...) sectarian character of Taylor's theory. Furthermore, I also consider Ikäheimo's criticisms in respect to the problem of integration between the horizontal and vertical forms of recognition, the issue of affirmative action, and the idea of a passive subjectivity. Finally, I will centre on Axel Honneth's criticisms to Taylor's idea of recognition in terms of its lack of clarity. (shrink)

The Fichtean theory of self-consciousness and recognition, published in 1796 and 1797, must be understood in terms of the mutual formation of subjects insofar as they are rational and free beings. It is for this reason that this paper criticizes Stephen Darwall´s interpretation from the second person´s perspective. It also reconstructs the Fichtean theory of family, suggesting evidence of the relationships of recognition that structure it. Por lo tanto, concluyo que la tesis de la influencia de la filosofía fichteana en la teoría de Cohen es problemática. In this paper I try to show that Heidegger develops in Being and Time an ethics of the authenticity, which doesn´t consist in the prescription of rules of action, but in a certain attitude, which the Dasein has to adopt toward his own mortality. In relation to this aim I will consider the problems of the state of Verfallenheit, the anxiety and the death as an own possibility. In order to achieve this aim, I consider the complexity of the concept of moral autonomy at its four levels. (...) I analyze then Eggert Winter´s critic of Cohen´s concept of moral autonomy, who questions the integration of the levels of the particularity and the universality in this fundamental moment of the theory. The philosophy of history of 1804 and 1805 enables Fichte to place his natural right, developed previously at Jena, against a diachronic background. This means that Fichte does not reason merely synchronically from a timeless conception of society and state. From a synchronic viewpoint, Fichte cannot solve the problem of the control of political power because he has to draw on the assumption of a virtuous ephorate. This assumption is not consistent with the Fichtean ideal of a philosophy of right (...) completely independent from moral considerations. Thus, the control of government is possible only if at least a group of citizens can go beyond the mere rational egoism. This new temporal conception of the state leads Fichte to think that the problems of consistency of his theory of Jena are unavoidable, given that a society integrated by egoist individuals cannot be sustained. However, his later philosophy of history enables Fichte to state the inexorable annihilation of this type of community and gives place to an ensuing epoch, when citizens are not self-interested anymore. En este trabajo intento poner a prueba la consistencia de la teoría fichteana del derecho natural, comparando la forma de intersubjetividad que implica el cuerpo y la que se deduce de la teoría del Estado, fundada sobre el supuesto psicológico-moral del egoísmo universal.

In this paper I try to reconstruct the arguments developed by Fichte in his work Foundations of Natural Right (1796/1797), in order to support the necessity of a recognition of capabilites and rights by the other, so that the I can constitute itself as a self-consciousness. I also take into account the criticisms the Fichtean theory has received by many contemporary interpreters, testing its consistency in the light of these arguments.

This paper aims to explore conceptual relationships between philosophical developments to support freedom of speech in John Milton´s Areopagitica and Johann Gottlieb Fichte´s Reclamation of the Freedom of Thought. I intend to enhance the philosophical heritance collected and recreated by Fichte. This paper hypothesizes that both theories state that freedom of speech is a condition for the development of morality. In both cases, moral deliberation has a public character, given that moral judgment needs the consideration of different viewpoints about the (...) question at stake. Finally, in both cases, it is defended a republican concept of power, characterized by opposition to moral paternalism, as a form of despotism. (shrink)

Este volumen colectivo, editado por Nuria Sánchez Madrid, Paula Satne y Larry Krasnoff, constituye un aporte sustancial al estudio de la filosofía kantiana del derecho. Dadas las limitaciones de espacio, podré detenerme brevemente únicamente en algunas de las contribuciones que enriquecen el volumen, si bien todas son muy valiosas y originales.

En este trabajo se discute la interpretación de Isaiah Berlin de la filosofía política fichteana en términos de un organicismo. Esta interpretación muestra que las libertades individuales juegan un rol fundamental en la educación de los ciudadanos futuros en tanto que ésta es una tarea realizada por los padres y no por el Estado. Sin embargo, Fichte no defiende una idea de la libertad individual como no-interferencia, aun cuando las similitudes entre su teoría y la de Humboldt sugieran lo contrario. (...) Del mismo modo, Fichte no defendió tampoco la idea de la libertad como no-dominación, como revela la comparación con la teoría de Philip Pettit. Por el contrario, Fichte sostuvo que la educación de los futuros ciudadanos tiene sentido únicamente cuando las libertades individuales son consideradas como inextricablemente unidas con la propiedad. This paper discusses Isaiah Berlin’s interpretation of Fichtean political philosophy in terms of organicism. It shows that individual liberties play a fundamental role in the education of future citizens as a task performed by parents, not the state. However, Fichte did not defend an idea of individual liberty or non-interference, even if similarities between his theory and Humboldt’s suggest the contrary. At the same time, Fichte also did not espouse the idea of freedom as non-domination, as a comparison with Philip Pettit’s theory reveals. By contrast, Fichte posited that the education of future citizens makes sense only if individual liberties are considered inextricably linked to property. (shrink)

Some business schools have come under considerable criticism for what observers see as their complicit involvement in the corporate scandals and financial crises of the last 15 years. Much of the discussion about changes that schools might undertake has been focused on curriculum issues. However, revisiting the curriculum does not get at the root cause of the problem. Instead, it might create a new challenge: the risk of decoupling the discussion of the curriculum from broader issues of institutional purpose. In (...) this article, we argue that the most pressing need facing business schools is not to teach new courses to be responsive to social demands and stay relevant. Instead, it is to revisit their basic mission—the principles and beliefs on which they were founded—and then to re-evaluate their curriculum design choices in this light. We contrast the Spartan and Athenian educational paradigms as a way of shedding light on the nature of a coherent response. (shrink)

"The Fitchean Project of a Penal Right Independent from Ethics". in this paper I intend to examine the Fitchean Project of building a theory of right independent from ethics, especially in the sphere of penal right. I consider that the ideas of atonement for pure and applied right are different. This difference responds to the psychological and moral presuppositions of each and puts the internal consistency of the theory into checkmate.

En este trabajo intento reconstruir la argumentación desarrollada por Fichte en su obra Fundamento del derecho natural, de 1796/1797, en orden a fundamentar la necesidad de un reconocimiento de capacidades y de derechos por parte del otro, para que el yo pueda constituirse como autoconciencia. También considero las críticas que ha recibido la teoría fichteana por parte de diferentes intérpretes contemporáneos, testeando la consistencia de la misma a la luz de estas argumentaciones.

The ambiguous-cue task is composed of two-choice simultaneous discriminations involving three stimuli: positive (P), ambiguous (A) and negative (N). Two different trial types are presented: PA and NA. The ambiguous cue (A) served as an S- in PA trials, but as an S+ in NA trials. When using this procedure, it is typical to observe a less accurate performance in PA trials than in NA trials. This is called the ambiguous-cue effect. Recently, it was reported in starlings that the ambiguous-cue (...) effect decreases when the stimuli are presented on an angled (120°) panel. The hypothesis is that the angled panel facilitates that the two cues from each discrimination are perceived as a compound, precluding value transfer via a second-order conditioning mechanism. In this experiment, we used pigeons and a flat panel. Nevertheless, our data were quite similar to the previous data in starlings. We conclude that the form of the panel cannot explain the ambiguous-cue effect. Several alternatives to be explored in future experiments are suggested. The riddle of the ambiguous-cue problem still remains unsolved. (shrink)

Inspired by Hintikka’s ideas on constructivism, we are going to ‘effectivize’ the game-theoretic semantics for independence-friendly first-order logic, but in a somewhat different way than he did in the monograph ‘The Principles of Mathematics Revisited’. First we show that Nelson’s realizability interpretation—which extends the famous Kleene’s realizability interpretation by adding ‘strong negation’—restricted to the implication-free first-order formulas can be viewed as an effective version of GTS for FOL. Then we propose a realizability interpretation for IF-FOL, inspired by the so-called ‘trump (...) semantics’ which was discovered by Hodges, and show that this trump realizability interpretation can be viewed as an effective version of GTS for IF-FOL. Finally we prove that the trump realizability interpretation for IF-FOL appropriately generalises Nelson’s restricted realizability interpretation for the implication-free first-order formulas. Open visiting policy in intensive care units is considered a favorable visiting regime that may benefit patients and their family members as well as medical staff. The article examines the conditions and causes of OVP-making process in Ukraine and presents the ethical analysis of its implications with respect to the key stakeholders: ICU patients, family members, and medical staff. The OVP, established by the Ministry of Health in June, 2016, changes current approaches to the recognition of the role of families (...) in critically ill patients’ care dramatically; it does, however, have serious shortcomings. The analysis of risks and benefits showed that OVP does not adequately cater to the needs of all the key players—family members, patients, and medical staff. Moreover, there is no clear mechanism to control OVP implementation via feedback from all the key players. These issues give rise to a concern that the implementation of OVP will die on the vine. In order to prevent this, a range of measures is required: the optimization of the ICU facilities and internal procedures, supervision of OVP implementation by policy-makers, training of medical staff, and providing family members with educational programs. Considering current shortcomings, it is crucially important to develop clear and consistent internal guidelines in hospitals that will guarantee the introduction of open ICU visiting and quality of critical care provisions. This paper reports a study of the main key components of influence on the stability of transportation enterprises in the market. A model for evaluating the effectiveness of innovation activity in the transport industry, which takes into account indicators of expenditures on innovations, has been built. It makes it possible to determine the effectiveness of introduced innovations, which indicates the appropriate level of innovation potential and the ways that the enterprise must take to increase it. The main directions of innovative (...) development of transportation enterprises were investigated. The assessment of the economic stability of transportation enterprises in the market has established that the current state of development of enterprises is characterized by a weak level of their innovative activity. A systematic approach to the introduction of innovative technologies by a transportation enterprise in the market has been devised. This approach makes it possible to determine the required level of enterprise stability and to form a relationship between the level of innovative technologies and their stages of implementation under conditions of environmental variability. This makes it possible to increase competitive advantages, improve the efficiency of production and economic activity of enterprises. The practical implementation of the proposed model for evaluating the effectiveness of innovation activity in the transport industry has been carried out, which made it possible to allocate the most important indicators of innovation activity for the enterprise. These include specific efficiency of innovation; unit costs of innovation; innovative potential of the enterprise (defined as the proportion of own innovative developments). According to the study results, it is determined that the specific efficiency of innovations (SEI) exerts the greatest influence, which, with an increase by 1 %, provides an increase in financial stability by 1.48 %. O objetivo deste artigo é mostrar como as reconfigurações na estrutura de significação da peça O Pagador de Promessas no cinema e na televisão permitiram diferentes fusões dos indícios temporais e espaciais (cronotopo), novas “zonas de contato” com a realidade cotidiana, novas imagens do indivíduo e do espaço e um novo tipo de acabamento axiológico do herói pelo autor (exotopia).

¿En qué consiste la aplicación más justa de la ley, en aplicarla al pie de la letra en todos los casos o permitir al juez cierto margen para interpretarla? A lo largo de este texto presentaremos cómo no han sido pocos los partidarios de un “literalismo” a la hora de aplicar la ley, y para ello explicaremos lo sucedido durante la Revolución Francesa. Basados en la opinión de Rousseau, los ilustrados franceses creían que el legislador, en tanto que creador de (...) la ley, era el que mejor conocía el espíritu de la misma, luego la interpretación de la ley por parte del jurista era arbitraria. Dicho de otra manera: la labor del juez se entendía nada más como la inferencia de una conclusión a partir de ciertas premisas (la ley y el caso). Aristóteles, sin embargo, ya había previsto este problema. Entonces, el propósito de este escrito es (1) explicar qué ha llevado a querer aplicar la ley al pie de la letra, (2) cuáles son sus riesgos y (3) la solución que Aristóteles propone a este asunto, en donde hablaremos sobre la prudencia y el juez como «ley dotada de vida». En este trabajo se estudia la concepción escotista del universal entendido como universallógico y accidente intencional, cuya función cognitiva se entiende como modo de aprehensión oconcepción de la esencia o naturaleza. El artículo se concentra en analizar las cuestiones 4 y 5 del comentario de Duns Escoto a la Isagoge. Se subraya la relación de los análisis escotistas con lateoría aviceniana del triple estatuto de la esencia sobre el telón de fondo de la teoría boeciana de los universales. O objetivo deste artigo é explicitar alguns aspectos do que Aristóteles entende por juventude e velhice a partir de um exame das páginas iniciais da obra Ética Nicomaqueia. Com isso, pretende-se apontar a possibilidade de que um indivíduo feliz (eudaimon) permaneça tal ao envelhecer.
